1. Scope and Acceptance
These Terms and Conditions (“Terms”) govern access to and use of bitemarketplace.com (the “Website”) and purchases made through Bite Resale. The Website is operated by OPERA ENGINEERING FZ-LLC (“Bite Resale”, “we”, “us” or “our”). By placing an order, creating an account or otherwise using the Website, you agree to these Terms.
These Terms apply to customers purchasing for delivery to the countries listed in section 8. They are intended primarily for consumers, meaning individuals acting for purposes outside their trade, business, craft or profession. Nothing in these Terms excludes, restricts or waives any mandatory right you have under the consumer-protection law of your country of habitual residence.
2. Consumer-Law Framework
For customers in the European Union, our sales are carried out in line with applicable EU consumer law as implemented in your Member State, including the Consumer Rights Directive (2011/83/EU), the Sale of Goods Directive (EU) 2019/771, the Unfair Contract Terms Directive (93/13/EEC) and the E-Commerce Directive (2000/31/EC). For customers in Switzerland, the applicable provisions of Swiss law apply.
Nothing in these Terms limits your statutory remedies for goods that are defective, damaged, incomplete, not as described or otherwise not in conformity with the contract.
3. Marketplace, Third-Party Fulfilment and Our Responsibility
Bite Resale operates an online e-commerce platform. Products are stored, packed and dispatched from warehouses located in the European Union, which may be operated by third-party fulfilment centres, couriers or logistics partners on our behalf.
Use of third-party fulfilment does not remove any responsibility that cannot lawfully be excluded. As the seller, Bite Resale remains responsible to you for the conformity of the goods and for the performance of the contract.
4. Eligibility and Customer Information
You must be at least 18 years old, or have the legal capacity to enter into a binding contract. You must provide accurate, current and complete billing, delivery and contact information and make sure the delivery address, telephone number and other order details are correct before submitting an order.
We may refuse or cancel an order where reasonably necessary, including where a product is unavailable, a price or product information contains an obvious error, payment is not authorised, fraud or misuse is suspected, delivery is not possible or the transaction would breach applicable law. If we cancel after receiving payment, we will refund the full amount without undue delay using the original payment method.
5. Product Information and Availability
We aim to display product descriptions, photographs, specifications, availability and prices accurately. Images may be illustrative and colours can vary depending on screen settings. The main characteristics shown on the product page form part of the product information.
Availability may change without notice. Adding an item to the cart does not reserve it. If an ordered item becomes unavailable, we will offer a replacement only with your agreement or cancel the affected item and refund the corresponding amount.
6. Prices, VAT and Payment
All prices are shown in euro (EUR) and are final prices including VAT where applicable. Delivery to the countries listed in section 8 is free of charge unless another cost is clearly shown before you place your order. The total price, including any additional charges, is displayed at checkout before you confirm the order.
Available payment methods are those displayed at checkout. You authorise us and our payment service providers to process the amounts shown at checkout. Where required, payments are subject to strong customer authentication by your bank or card issuer.
If an obvious pricing or technical error occurs, we may contact you before dispatch to correct the order or cancel it and issue a full refund.
7. Order Process and Contract Formation
To place an order, add products to your cart, proceed to checkout, enter your details, choose a payment method, review your order and click the order button, which clearly indicates an obligation to pay. Before submitting, you can check and correct any input errors.
Submitting an order is an offer to purchase. We send an automatic email acknowledging receipt, which does not in itself constitute acceptance. The contract is concluded when we confirm your order or dispatch the goods, whichever occurs first. The contract language is English. We store the order details and send you these Terms and your order confirmation on a durable medium (email).
8. Delivery
We deliver to: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.
Orders are shipped from our warehouse in the European Union. Delivery is free and the estimated delivery time is 2 to 6 business days after dispatch confirmation, depending on the destination and the carrier. Unless otherwise agreed, we will deliver the goods no later than 30 days after the conclusion of the contract. If we fail to deliver within that period or within an additional period you set, you may terminate the contract and receive a full refund.
Orders delivered within the EU are not subject to customs duties. Orders to Switzerland leave the EU customs territory and may be subject to Swiss import VAT and customs formalities; any such charges will be indicated where applicable.
The risk of loss of or damage to the goods passes to you only when you, or a third party indicated by you other than the carrier, take physical possession of them.
9. Inspection on Delivery
Please inspect the parcel and product promptly after delivery. If an item is damaged, incomplete, defective, incorrect or not as described, contact us at info@bitemarketplace.com with your order number, a description of the issue and, where available, photographs of the item and packaging. Late reporting does not remove any mandatory statutory right.
10. Right of Withdrawal (14 Days)
If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. For an order of multiple goods delivered separately, the period runs from receipt of the last item.
To exercise the right of withdrawal, you must inform us (OPERA ENGINEERING FZ-LLC, info@bitemarketplace.com) of your decision by an unequivocal statement, for example an email. You may use the model withdrawal form below, but it is not obligatory. It is sufficient to send your communication before the withdrawal period expires.
Effects of withdrawal: we will reimburse all payments received from you, including the costs of standard delivery, without undue delay and in any event no later than 14 days from the day we are informed of your decision to withdraw. We will use the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.
You must send back the goods without undue delay and in any event no later than 14 days from the day you communicate your withdrawal, to the return address we provide. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
The same 14-day withdrawal policy is offered on a voluntary basis to customers in Switzerland.
11. Exceptions to the Right of Withdrawal
As provided by law, the right of withdrawal does not apply to:
- goods made to your specifications or clearly personalised;
- goods liable to deteriorate or expire rapidly;
- sealed goods not suitable for return for health protection or hygiene reasons once unsealed after delivery;
- goods which, after delivery, are inseparably mixed with other items according to their nature;
- sealed audio or video recordings or computer software once unsealed after delivery;
- digital content not supplied on a tangible medium once supply has begun with your prior express consent and acknowledgement that you lose your right of withdrawal.

13. Legal Guarantee of Conformity
All products are covered by the legal guarantee of conformity. In the EU, we are liable for any lack of conformity which exists at the time of delivery and becomes apparent within two years of delivery (or a longer period where provided by your national law). In Switzerland, the statutory warranty provisions of the Swiss Code of Obligations apply.
If a product is not in conformity, you are entitled to have it brought into conformity by repair or replacement free of charge, within a reasonable time and without significant inconvenience. Where repair or replacement is impossible, disproportionate, not carried out within a reasonable time, or the defect is serious, you are entitled to a proportionate price reduction or to terminate the contract and receive a refund. We bear the costs of returning non-conforming goods.
14. Commercial Warranties
Any manufacturer or commercial warranty displayed on the product page or supplied with the product is in addition to, and does not affect, your legal guarantee rights.
15. Refunds
Refunds are issued to the original payment method. The time for the refund to appear on your account may depend on your bank, card issuer or payment provider.
16. Order Cancellation Before Dispatch
If you wish to cancel an order before dispatch, contact info@bitemarketplace.com as soon as possible. If the order has already been dispatched, you can still use your right of withdrawal after delivery.
17. Failed Delivery and Unclaimed Orders
If delivery fails because the information you supplied is incorrect, or because you are unavailable after reasonable delivery attempts and do not collect the parcel, the order may be returned to us. In that case we will contact you and refund the order, less any reasonable return-shipping costs we have incurred, to the extent permitted by law. No such costs will be charged where the failure is caused by us or our carrier.
18. Customer Accounts
If you create an account, you are responsible for keeping your login credentials confidential. Notify us promptly if you believe your account has been compromised. We may suspend an account where reasonably necessary to protect customers, prevent fraud or comply with law.
19. Acceptable Use
You must not misuse the Website, attempt unauthorised access, introduce malicious code, interfere with Website operation, scrape or reproduce protected content unlawfully, submit fraudulent orders, abuse promotions or returns, impersonate another person or use the Website for unlawful purposes.
20. Intellectual Property
Unless otherwise stated, the Website, its layout, branding, text, graphics, software and other original content are owned by or licensed to Bite Resale and are protected by intellectual-property laws. Third-party names, trademarks and images remain the property of their respective owners. You may use the Website for personal, lawful shopping purposes only.
21. Reviews and User Content
Reviews and other content you submit must be truthful, lawful and must not infringe third-party rights. You grant us a non-exclusive, royalty-free licence to display and reproduce that content for operating and promoting Bite Resale. We take reasonable steps to check that published reviews come from customers who have actually purchased the product, and we do not publish false reviews or manipulate reviews to mislead consumers.
22. Promotions and Discount Codes
Promotions may be subject to additional terms shown with the offer, such as validity dates, eligible products, minimum spend and usage limits. Unless stated otherwise, discount codes cannot be combined. When we announce a price reduction, the prior price shown is the lowest price applied during the 30 days before the reduction, as required by EU law.
23. Privacy
Personal data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR) and, for Swiss customers, the Swiss Federal Act on Data Protection (FADP).
24. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, under product-liability law, or any other liability that cannot be excluded or limited under applicable law. Subject to this, we are not liable for losses that were not reasonably foreseeable when the contract was concluded.
25. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, provided we take reasonable steps to limit their effects. If such an event prevents performance for an extended period, you may cancel the affected order and receive a full refund.
26. Complaints and Dispute Resolution
Complaints may be sent to info@bitemarketplace.com. Please include your order number and the details needed for us to investigate. We aim to respond as quickly as possible.
If we cannot resolve your complaint, you may contact the consumer-protection authority or an alternative dispute resolution body in your country, or the European Consumer Centre (ECC-Net) for cross-border disputes. We are not obliged, and do not commit, to participate in dispute-resolution proceedings before a consumer arbitration board, but we will consider any such request in good faith.
27. Governing Law and Jurisdiction
These Terms are governed by the law of the country in which you have your habitual residence as a consumer. You may bring proceedings in the courts of your country of residence. This does not deprive you of the protection afforded by the mandatory provisions of that law.
28. Changes to These Terms
We may update these Terms from time to time. The version applicable to your order is the version in force when the order was placed. Updated Terms will be published on the Website with a revised effective date.
29. Severability and No Waiver
If any provision is found invalid or unenforceable, the remaining provisions remain in effect. A delay or failure by us to enforce a right does not waive that right.
30. Language
These Terms are provided in English. Where we provide a translation, the translation will not reduce any of your statutory rights.
